The stagecoach has arrived from our state capital in Kingston, and it brings wonderful news. And our supervisor is going to tell us all about it. This will be the New York State Law establishing the town of Riverhead, Chapter 24. Passed to 13. March 1792. An act of the New York State Legislature establishing the town of Riverhead reads as follows. An act to divide the town of Southhold into Suffolk County. The preamble. Whereas many of the freeholders and inhabitants of Southhold in Suffolk County have presented to the legislator that their town is so long that it is very inconvenient for them to attend town meetings and also to transact the other notary public's name. Okay, another quick announcement. Tomorrow, March 20th, is the first day of the 2024 spring and summer registration with the Riverhead Recreation Department. Residents can register online via the new online registration portal, in person or over the telephone. And once again, a reminder, the Rec Department has moved to this building. They're on the second floor. And if you need to get your beach passes or anything else from the Recreation Department, you come here, not Stotsky Park anymore. There won't be anybody here. They'll be there for you. So, come to this building. Or you can visit them online at riverheadrecreation.net. Riverhead recreation being one word. Lastly, Councilman Waskie, I believe we have a parade coming to town soon? We do. Thank you, Mr. Supervisor. Yes, we received six letters reference to comp plan. And all letters that come into town board or come into the town hall now are scanned in and put on the town clerk's page on our website. And they can be read in their entirety just by going to town clerk and going to correspondence. And you can see exactly what was written in these letters. The letters came from Carolee Olson, Ellen O'Connor, Margaret and Bill Fortunato, Ann Marie Minacucci, Susan Bondren and Paulette Jasinski. Those all referenced the comp plan. We also received a letter from Elaine and Mark McDuffie reference to cannabis legislation. And also, Gene O'Rourke referenced the charter school. And that was it for correspondence. Under reports, we received two tax collection reports from our tax receiver. As of March 6th, it was $95,200,000 was collected. As of March 13th, $95,400,000 was collected. We got the total. The utility payments received for the month of February was $309,787.95. We received the monthly report from the Riverhead Police Department for the month of February. And the town clerk's monthly report for February was $10,736.72. That concludes our reports. Thank you, Mr. Wooten. We are now going to move on to our public hearing portion of the meeting. We have one public hearing scheduled for tonight. It's scheduled for 6.05 p.m. And it is now 6.10. And this will be reference a site plan at 901-923 Berman Boulevard Warehouse in Calverton. And I would ask Mr. Greg Bergman to please explain. Mr. All right. Thank you. Good evening, Mr. Supervisor, members of the town board. For the record, my name is Greg Bergman, senior planner with the town of Riverhead Planning Department. I will also start by acknowledging receipt of the affidavit of posting and the proof of mailings for tonight's public hearing in a court. And I will also be presenting the final report in accordance with town code. The subject of tonight's public hearing is a preliminary site plan application known as 901-923 Berman Boulevard, which is seeking approval to construct a new 40-foot tall, 84,250 square foot commercial warehouse on a 20.58-acre parcel of land identified as Suffolk County tax map number 600-135.10-1-3, which is located at 901-923 Berman Boulevard, California. Thank you. Thank you. zoning use district located within the industrial core of the epcal property colloquially known as the berman subdivision or the calverton camelot subdivision subject property is presently improved with a multi-story 134 000 square foot building which also includes the air traffic control tower for the runways at epcal the town board by resolution number 2023-784 dated october 17th 2023 classified the action as a type 1 action pursuant to secret and initiated coordinated secret review among involved agencies to date we received correspondence from the suffolk county planning commission which considered the matter to be one for local determination from the new york state office of parks recreation and historic preservation which found that there would be no significant impacts to historic structures and from the suffolk county department health services which provided technical responses related to article 6 of the suffolk county sanitary code no objections were raised to the town's lead agency request by resolution number 2024-232 the town board assumed lead agency status and issued a negative declaration finding that the proposed action was not anticipated to have any significant negative environmental impacts along with the proposed 84 250 square foot warehouse the application proposes to relocate the existing on-site water main which the riverhead water district through its consulting engineers is in the process of preparing a engineering map and plan for space management in the future the riverhead water district in the future the riverhead water district in the future the riverhead water district in the future the riverhead water district in the future the riverhead water district in the future the riverhead water district in the future riverhead water district in the future the riverhead water district in the future riverhead water district in the future riverhead water district in the future riverhead water district in the future riverhead water district in the future riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed riverbed provide an attractive visual statement to those entering the industrial park as this is the first site you see when you come into the park from middle country road landscaping is also proposed throughout the site including plantings around the buildings as requested by the town's architectural review board we do have representatives from the application here believe we have bram weber from weber law group at this point i would invite him up and if the board has any questions i'm available to answer counselor weber would you like to step up to the microphone thank you good evening just some brief remarks about the application may i have the site plan or the aerial excuse me the first slide on the screen he asked me not to shout he said he would be able to hear me okay thank you
so while we do that um again i'm bram weber from weber law group i'm the attorney for the applicant allison scolfani is with me she is also a part of my firm has worked on this application with me um we also have chris vorhees from nelson and pope who's our civil engineer and mike ciara from nelson and pope who's our project architect you'll hear from them um very briefly uh in a minute uh so that's an aerial of the existing conditions thank you um and as mr bergman said this is an application to add a modern industrial building to the well-established enterprise park in calverton the proposal is for an 84 250 square foot building on unused land immediately adjacent to the existing building on the north side of the property um i had a um a uh laser pointer which i thought i'd be able to show you exactly on the property where it is but um that doesn't work on the screens yours are very sophisticated so i i can't do that um but we can look to see basically as you're looking uh for the audience's perspective to the left of the building that's where the new building will be and if i can have the second slide please that will show um better on the on the screen where it is uh the the property size is 20.5 acres and the new building is proposed to include 8242 square feet of office space with the remainder is warehouse or space or other manufacturing use as this board is aware the property already has on it a 184 586 square foot industrial building which is the home of riley custom architectural and old castle riley custom architectural is a subsidiary of pella windows and that is pella's specialty custom window and door manufacturer for the luxury market that's one tenant currently in building the other tenant old castle is a subsidiary of crhplc which happens to be the largest company in ireland an old castle provides outdoor materials for home improvements such as brick and tile and other materials such as brick and tile and other materials such as brick and tile and other materials such as brick and tile and other materials such as bricks masonry and decking old castles approximately 25 employees at the property and riley has approximately 130 employees at the property and the applicant which is an affiliate of caber group caber is a very well known owner developer and manager of commercial properties our original proposal was for 200 000 square feet or roughly that working with the planning department we reduced the size of that building more than half to its current size and we have a new building that is a new building that is a new building that is a new building through its current 84 250 square feet through its current 84 250 square feet we added green space and landscaping as you can see from we added green space and landscaping as you can see from the uh at the uh from the video screen we're adding as mr bergman said landscaping along burman boulevard going to make that a much nicer view formalizing curb cuts we're formalizing parking we're adding a specific trailer parking to the site and all told what you're looking at is a vast the property itself will be vastly improved from what exists and through what we're doing through And through working with the planning department and the architectural review board, we've incorporated basically every substantive comment that we've been asked to incorporate into the site. Have made, I think, the site overall better and will be a nice improvement. It's going to add an opportunity for job creation, add to the tax base, and it's in the middle of the industrial park. I had a few more comments to make, but I think that for purposes now, I'd like to turn it over to Chris Voorhees, who can give you some brief specifics on the plan itself. Counselor, is this project going after IDA benefits? So, so far, we have not made an application to the town for IDA benefits. I can't say that it won't necessarily. I think right now we're in the process of trying to get through the site plan approval and then see where we are with a potential tenant. And if that tenant's going to be a significant enough addition to the town and its tax base and its job base, then maybe we would. But we don't have any plans just yet. Okay. Thank you.
Hello. My name is Christopher Voorhees. I'm a professional engineer and project manager with Nelson Pope Engineering, located at 70 Maxis Road, Melville, New York. And I am the site engineer for... I'm the site engineer for this project. Much of the existing conditions has already been described. A couple of details that I want to point out. So the site currently has... We flip back one slide and go to the existing conditions, please. Okay. So what we're looking at is a site that's mostly developed with impervious surfaces, both building and paving, as well as a large lawn area in the center of the property to the left of the screen. That is your... That is your traditional lawn type landscaping. On the upper left corner of the property is a little bit more of tall grasses, so more of what you would see as a native condition. In addition to that, there's a couple of street trees along the roadways. So going to the next slide for the proposed project.
It's important to note that we are keeping a lot of the same ratios. In fact, we are actually reducing the amount of impervious surface on the site by a small amount. But the improvements that we're making to the landscape are the noteworthy points. So the... As I indicated before, the existing majority of the site... Actually, let me rephrase that. The site is split between about lawn and the meadow grasses, about 50-50 in the existing conditions. Under our proposed landscape... We're going to be re-vegetating the majority of the site with meadow mix. So that's going to be a native grass type species that's going to have a higher grass and less maintenance. More natural native vegetation. That is going to be balanced with a very small amount of lawn landscaping just on the main drive between the buildings and a couple of areas around the building perimeter. In addition to the change in vegetation, we're adding shade trees to the site. To around the street primarily. And then a couple of key locations throughout the interior. As mentioned before, we're improving the road frontage with additional landscape beds and formalizing the site access. While providing a substantial truck loading. We're designing that in accordance with the Town of Riverhead and the New York State Stormwater Design Manual, as well as the other improvements mentioned, water relocation, drainage, and sewer connections. In addition, the site will include erosion control, best management practices, and those will be including construction entrances, soil stockpiled containment areas, concrete washout, drainage inlet, and perimeter silt fencing, in addition to dust control procedures. So that's the proposed project in a nutshell, and I'd like to turn it to the project architect to describe the building.
Good evening, ladies. Ladies and gentlemen of the board, pleasure to be here. My name is Michael Sciarra. It's S-C-I-A-R-A, and I am senior partner, registered architect with Nelson Pope Architects and Engineers, 70 Maxis Road, Melville. And just to describe a little bit of the building design, as it was stated by Mr. Weber, in conjunction with working with the planning board, we significantly reduced the size of this building more than half. So the building now stands at 85, roughly 85. And the goal of this project was also to not only create a building that was aesthetically pleasing for what it is, which is an industrial building, but also be compliant with all of the standards within the zoning law for a PIP zone. So the building took shape, and as you can see from the renderings that are on the screen, one of the points within the zoning is to have somewhat of some undulation, within the facade itself, so there's some staggering of heights. And that allows for some greater interest in the facade. And so we kept, again, with town zoning on that, as well as the percentage of glazing. So they're certainly trying to mitigate any type of wall effect that may result in the building design of an industrial building that it is. It's a warehouse. We can't get around that. But providing glazing. We even took into consideration. The planning board's comments to add additional glazing, especially on Berman, which we did. You can see that evidenced in the next slide. We added glazing there. That's on the east facade. And the materials, again, standard of what you would find in, I would say, modern day industrial design right now, which is precast concrete panels. We can play with color a bit. We also mix the materials. We, again, try to mitigate that wall effect by a mixed use of media. So we have architectural metal panels to define the entrance, as well as architectural insulated corrugated metal panels, as well, to create interest, as well as to kind of mark the doorways, the entrances and exits from the facility. So that provided a nice architectural feature, as well as functional. And then as far as the building itself, we imagine that all, you know, sustainable best practices. We have to meet the thresholds of the energy code here. And so from mechanicals to plumbing fixtures to sustainable materials, as much as practical, will be utilized. Lighting will be all dark sky compliant. So that'll mitigate any concern for any light pollution. It will not be spilling on neighboring properties. That goes for the site lighting, as well as any lighting that's going to be used. So that's something that we're looking at. And then we have a lot of work to do. We have a lot of work to do. We have a lot of work to do. We have a lot of work to do. We have a lot of work to do. We have a lot of work to do. So that's something that's going to be attached to the building itself. It'll be shining down. And we'll have a lighting consultant to verify all the photometrics and make sure that there's no light spill on any neighboring properties. And in terms of town board, again, town board comments, we've addressed pretty much every single one of them. And we are presenting an as-of-right building. So if there's any questions about the building design, I'd be happy to answer them. Thank you. Thank you. I have no further testimony other than just to reiterate the final point, which is this building, as I neglected to mention before, requires no variances. If the size is proposed, it's as of right. I just would say that, I mean, this is a project as a warehouse that's being built, you know, where we'd like to see them, in the industrial core. And I'm very happy to see that the landscape that's being involved in this is going to kind of eliminate some of the blithe right in that area, just, you know, for aesthetics purposes. So, it is an industrial core, and we've got lots of companies that invested in Riverhead. But I hope that the landscaping on this facility, as I said during our work session, will kind of transform into the adjacent owners as well, and kind of begin to make it a more beautiful passageway, you know, as you go in from River Road down to Route 25. So, I'm glad that you're adding that, and I think it's a great project. Thank you. Thanks. Do we have anybody from the audience who would like to comment on this public hearing? Wooten okay resolution 237 authorizes the supervisor to execute an agreement with LVF landscape architects PLLC so moved second vote please sorry names Oh wasky yes I forgot what I was supposed to do Murrayfield yes turn yes Rothwell yes Hubbard yes resolution pass resolution 238 authorizes the supervisor to execute a license agreement with Celtic quest Inc so moved seconded vote please wasky yes thank you very few I just like to state that I had received letters from residents in the Jamesport area and also the Civic Association in Jamesport concerned about the possibility of the pump station they're being blocked by the boat and I just like to let everyone on they were also concerned about possibly the boat using the pump the the pump out tank and not making it available for residents have checked with the sewer department they are going to make the pump is pumped is pumped out every Friday evening before the weekend starts and they're going to check on it more often frequently to make sure that there isn't a problem and secondly with regard to the contract people were concerned that the boat would block the pump out station there and I just want to point out for everybody in the contract the licensee really can't interfere it's right in the contract how he's not permitted to interfere with access for individuals utilizing the dock and also amenities associated with the dock so that would include and that's under F that's under obligations of the license of license or article for the license he warrants and covenants that the vessel will be operated and secured when it's not in operation in a safe and careful way more specifically shall not be a public or private nuisance or interfere with the peaceful enjoyment of the DOCA Marina by others without authorization by the DOCA Marina Corporation in the thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you thank you by others or be a source of environmental pollution. My extracurricular interests include playing trumpet, which I've done since fifth grade, and I really enjoy being part of bands such as the Symphonic Band, Wind Ensemble, and Jazz Band, and this is just my experience. We know that Riverhead Central School District educates all students. Every student is given the chance to succeed with opportunities to take many classes that meet their interests, and the teachers will work tirelessly to meet all the needs of all the students. Yes, sir. Hi, my name is Alex Pasquale. I live in Jamesport. And I'm a senior at Riverhead High School. I am writing to address the proposed expansion of the charter high school and to advocate for the preservation of open space in our beloved Riverhead schools. I feel compelled to address why I believe it is not in the best interest of our community. Having spent seven years at Riverhead Charter School, I witnessed firsthand the limitations and shortcomings of its educational approach. Over the years, I've witnessed a trend among my peers at the charter school. Many of them, including close friends and family, have been chosen to transfer to other schools. The reasons echo a common sentiment. They feel deprived of the full school experience and the lack of freedom available to them at the charter school. The minimal inclusivity and failure to promote academics for all students became apparent, leading many of my peers to seek a more fulfilling education elsewhere. Teachers at Riverhead Charter School are invested in achieving students. However, students who struggle or resist leave without attention. In contrast, teachers at Riverhead are invested in all students and push them to achieve. When I transferred to Riverhead High School, I experienced an increased a big shift suddenly I found myself in a community brimming with school spirit and support from our community staff and teachers particularly during events such as homecoming the unwavering backing of the community has played a big role in having a sense of belonging and school spirit among students however I concerned about the potential ramifications of the proposed expansion of the charter school not only does it pose a threat to the environment that Riverhead stands for as it is a traditional farm community with open fields and spaces but also jeopardizes the opportunities that are integral to students with the expansion of the charter school there is a sense of risk that sports teams clubs and other activities at Riverhead could face the motion depriving students of valuable growth opportunities additionally money going to the charter school takes money away from the public school district which limits opportunities for students here at Riverhead schools I urge our community and officials to come together and resist the expansion of the charter school let us ensure that future generations have the opportunity to speak the same sense of communities schools spirit traditions and lifestyle than many have witnessed in the past thank you
hello ladies and gentlemen good to see you some of you know me some of you do not I am Georgette laws here I live in South James port I was known as Georgette Keller as some of you probably remember me as, past president of the Civic, founder of Save Main Road, was on landmarks for 15 years. So it's been a while since I've been here at your podium, but I'm coming before you tonight because of the charter school proposed expansion that they withdrew. But part of the reason why I'm here with that is because this is the second time that we have seen proposed, actually third time we've seen proposed development along our historic corridors of Main Road or Sound Avenue for structures that are incompatible with our community. The first being now that Sharpers Hill is preserved when they wanted to build condos and a strip mall across from the Elbow Room. The second being the proposed YMCA that they wanted to put on Main Road. And now this structure. First of all, this structure is in the Agricultural Preservation Zone, the APZ. And as such, we need to think about 50 years from now how many acres of farmland we're willing to give up because every acre that's given up, it never comes back. It's never going to come back. And some of you may know, and I'm sure most of you know, that in 1976, the New York State Office of Historic Places designated Sound Avenue as a historic corridor. Both Sound Avenue and Main Road qualify to be national registered districts. We did not succeed with that on Main Road fist round, but there may be a second round. Just a little warning there. And that being said, I think that the town board needs to consider maybe amending the town code as it pertains to special permits within areas or parcels of land that are to have that designation so that there is an appropriate limit based on where it exists in the town on the size of the structure because what they proposed for this particular project is twice the size of Roanoke Avenue School where I teach for the same number of students. That being said, it's also across the street from a winery and next door to a liquor store so I wasn't quite following the thinking there. But that being said, it's also neighborhood farming communities. That is our identity. That is the basis of our summer tourism and year-round tourism with the wineries and the agricultural tourism that we do. And it is also a funding issue for our school district. Mr. Hubbard, our daughters graduated together. Mr. Wooten, we educated your daughter at Roanoke. We had her there. My granddaughter is at Roanoke and in part of the school district. So I'm very proud of her. I'm part of the Riverhead School District system now too. And we need to make sure that we're preserving funding for all students, not disproportionately more for those who attend charter school as a public school. And yes, as the young man has attested to, when they can't provide services, those students then come to us. And it has been very unseemly for the accusations coming from the charter school about the cost of the quality of education that we provide in our public school district that serves everyone. So it is unfair for an elite few to get more funding than the rest of our students. That being said, on funding, please do something about the IDA credits because it disproportionately hurts us as educators of our children in our community. And I live in the community where I teach for a reason. And that's to make a difference. And those of you who know me, that from the minute I set foot in the town of Riverhead, I have been part of improving our community any way I can. So I ask you and implore you to do something about the IDA and to be on board with our school district and our union who has become quite vocal about our pilot taxes too. We have the beautiful Wildwood State Park and all, but we need the payment in lieu of taxes. Our kids need it now more than ever in a post-pandemic world where we as teachers are working tirelessly to close the gaps that were created. And that is a benefit to all of our community because the better education we provide to all students the better our town does in terms of its property values, which means you get more tax dollars and we can do more for our entire community. Our education system is the bedrock of our community having a better quality of life too. The more education our children have, the more opportunities to success they have, and that means that they will have viable jobs and will be able to afford to continue living in our town. I teach fourth grade for 24 years in Riverhead. I plan to live forever, but assuming I do, I will die in Riverhead. My parents are from here, and a lot of things have been going on with the district and the charter school and things like that, and there's a couple things I wanted to say about it. I was with my parents this weekend, and they said, you need to go and publicly speak about it, because that's what they do. My father was a military man. He was a military man. He was a deputy warden of the JL in Riverhead before he retired after many years. And one of the things he always told me was to question things, and I question a lot. And one of the main questions I had as an educator in this district was just when it comes down to the amount of money. The amount of money where we per student, I wrote it on my little note card here so I wouldn't make a mistake. Per student, at around $15,000 per student for us, but when you go to the charter school, it's $18,000. So the idea around that amount, or $19,000. The idea of where's the money coming from? Right. Where's the money going? What happens? Who's accountable? There's no accountability. No one ever seems to know. When you ask questions, people don't always answer. And like, you know, the past 12, 13 years, around $80 million, that's insane amount of money. And no one seems to know where it goes, where it's spent. You talk to students. I was talking to him earlier before he got up here. Where does it go? If the Jets signed someone for 12 years, $80 million, we would lose our mind. People are on the news. People complain. They talk to the sports radio all the time. But when this happens, no one seems to say anything. You would want to know where it goes. The other thing that bothered me about this entire situation, and I go to my mom. I don't want to leave my mother out of this, because she might be watching, and she'll be upset. She's watching. My mom's from the south, Alabama, Civil Rights Movement, marched and walked with Dr. King, spoke to him. We have wonderful stories about her experiences. So for her and for me, I have a huge issue when someone has a situation, and they throw the race card out really quick because it's not going their way. I always have a problem with that, because that takes a shot at the people who dealt with stuff, the stuff she did with the boy cart, the Ruby Bridges stuff she lived through, all the dogs, the rocks. Everything my mother experiences, when things aren't going someone's way, they just quickly, oh, it's a race thing. It's a race thing. It's not always a race thing. It's a character thing. I have a poster in my classroom that the kids see all the time, and it says, character outweighs what people say about you. Those who know you know you. I know certain people where if someone said something about them, I'd immediately go, no chance, because I know the character. When you look at the character of some of the people involved in the situation, and we know what it is. We've seen things online, comments made in the past, things on Twitter, things like that. You challenge the character, you challenge everything else a part of it. You look at the money, everything becomes suspect, and we're confused. As people here, I live in this town, I pay taxes in this town, I work in the district for a long time. We question everything, and sometimes we want answers. But I'll speak. There was a lot of people outside today, but I'll speak for the voice of the voiceless, because they don't know I come inside. We're trying to preserve public education in Riverhead. A lot has gone on with the charter school over the last few weeks, and what I have come to know is that now they've applied for a special permit for portables on their property. And the sign that they're supposed to post saying that they've applied for a special permit as of this morning has not been posted. And the school has chosen to increase their enrollment, and it seems at a rate that they can't physically accommodate these children. We heard a lot of children talking about how crowded it was in their classrooms and not having a cafeteria. So, I don't know. I don't know. I don't know if they want to move middle school kids to the high school. I guess these are all things that'll come out once they have their hearing and whatnot. But I just want them to be held accountable to the same rules that everybody else has. If I want to build a shed or bring a shed to my property, I get a permit, and then I bring the shed. I look forward to your response to my Freedom of Information Act, Mr. Palumbo. freedom of information act uh request council i actually have another uh matter that i'd like to um raise not with uh mr howard um as part of your negotiations regarding the town square project um does the count contemplate a conveyance of property purchased by the town to mr petrucelli or companies that he controls mr very that matters being handled principally by miss prudente uh you're welcome to call the office and ask her any questions that you have about that well i imagine it's under your supervision and the supervision of the good members of the town board so it's a simple question mr very nothing's been finalized on that at this point if you have specific questions about the project i would ask you to call miss prudente or write an email to her she will respond to you i need to remind you that this is an open comment period not an open question period your questions can address any one of us in writing or email contacts will give you an answer but this is for your comments we will hear comments but not questions and accusations and inquisitions that you generally do i'm not so i'm mr harari i'm telling you a for comments only and if you can't adhere to that we will move on to the next speaker i appreciate that mr supervisor and i would just say my office routinely responds to inquiries from the public whether it be by phone or whether it be by email so if you do have specific questions about specific uh specific matters please do not you know hesitate to call my office i'm happy to i'm happy to make that call tomorrow i have another uh comment Can you confirm whether or not the $500,000 contract with the landscape architect for the town square project was the subject of a request for proposals?
