1:04We are gathered here today for a town board meeting.
1:07And as we start all of our meetings,
1:08we're going to please rise for the Pledge of Allegiance.

1:51Dear Lord, we thank you for our community
1:53and those whom invest their time and talent
1:55to help create a place we all can call home.
1:59We ask for your grace
1:59and for your blessing on our elected officials
2:01and give them the clarity of thought
2:03as they deliberate and ponder the future
2:05and destiny of our beautiful township.
2:08We ask you to comfort those in our community
2:10who are ill and troubled.
2:11Use their pain and their struggles.
2:14We ask for your spirit to be with all our police

2:18who have dedicated their lives

2:35Okay, we have a couple announcements.
2:37This weekend around town, we have a few events.
2:40I'd like to mention Friday, June 7th,
2:42CAP is holding and hosting their 37th annual
2:45Say No to Drugs March starting at Pulaski Street School.
2:49That begins at 9.30 a.m.
2:51Following the march, there will be a brief ceremony
2:53on the steps of the school.
2:56And they will address...
2:57People will address the students
2:59and the community after the ceremony.
3:01The Loyal Order of Moose Lodge number 1742
3:06will serve a picnic lunch to all students and guests.
3:09Saturday, June 8th, the Tour de Cure American Diabetes Bike Ride
3:13at the Hallockville Museum Farm starts at 6 a.m.
3:17Check-in is at 5 a.m.
3:19Watch out for the bikers on the roads.
3:21And last but not least, Sunday, June 9th,
3:24is Duck Pond Day and Street Market in Wading River.
3:27It is an annual tradition hosted by the Duck Pond
3:29Society and Wren Design Company.
3:32The event includes food, drinks, music, arts, and crafts,
3:36vendors, and some free giveaways.
3:38So those are just a few items that are going on
3:39this weekend around here.
3:42We're going to move in and we're going to take
3:45two resolutions, or one resolution out of the pack
3:48and go a little bit out of order and start with that
3:51right now because regarding the swearing in
3:53of new police officers, we have two young men
3:57that have been working with the Town of Wren.

5:40head's finest and they are our future um i look forward to working with both of you these are the
5:45two best candidates that riverhead could ever ask for and two remarkable young men so i wish you

5:57and what councilman rothwell just said we've had the honor of working with you in this building
6:02both of you for a number of months now and we've also known you before that and the work that you
6:08have done is incredible uh everybody's been doing a great job and i'm very proud of you and i'm very
6:10everybody still talks about the day the bus ran into the telephone pole over here and all you saw
6:15was smoke when andrew waski went out the door and headed right over to the scene uh two great young
6:20guys and you're only going to make our department better than it already is and that's pretty hard
6:24to do because we've got a pretty good police department so welcome and godspeed to you and
6:29let's go ahead and get the uh swearing in done down well right well first yes any place special

12:49One was canceled.
12:51The one that was canceled was titled Special Permit to Family Dwellings.

13:05So, we have a public hearing, Increase and Improvement in the Riverhead Sewer District.

13:29All right, so just a quick synopsis where we're at.
13:33Since 2019,
13:342019,
13:35back in the feasibility stage,
13:36all the way to 2024,
13:38this town has moved forward with plans and specs for the biosolids project
13:44and diligently have gotten to the point where we're ready to embark on the construction phase of this project.
13:49It's very exciting.
13:50And I believe this resolution is looking to assure that we match the proposed bond amount
13:56that was initially established way back in 2021
13:59to the current project costs that match the actual construction bids that we have received
14:04just recently.
14:05Throughout the project's timeline since 2019,
14:06COVID,
14:07supply chain issues have really impacted this project cost and timeline.
14:08And this proposed bond amount of $18,650,000 includes this cost and timeline impact as
14:09it stands today.
14:10And I'd like to point out that 75% of those cost impacts are due to material labor increases
14:11during that time period.
14:12But even with that,
14:13we're still in the process of getting to the point where we're ready to go.

15:00sludge improvement project. The new system will lower the average sludge handling costs
15:06from $1.2 million a year to $500,000 a year, a substantial decrease. The sludge handling costs
15:14savings, along with paying off the bond over a 20-year period, equates to approximately $96,000
15:21a year of savings for those first 20 years paying off the bond. But then when the bond is paid off,
15:28it will ratchet up to $860,000 in savings over the course of the year for the remaining 10.
15:35The total savings to the town over this life cycle of the new sludge project is $10.5 million
15:41to bring this in. I'd like to point out that in addition to the cost savings that are demonstrated
15:48by moving forward with this project, this new biosolids system is providing a huge environmental
15:54benefit also. The new process reduces waste and waste management costs, and it's a huge
15:58investment. But there's also a huge area of waste management that's being disposed of that is
16:02currently at 3,400 tons per year down to 700 tons per year. That's an 80% reduction of waste solids
16:11that have to be disposed in landfills and other places. So it's a win-win on both sides.
16:18That's a quick synopsis of where we're at today. Thank you very much for your time,

16:28Last time you were here, we're at 16 million.
16:31We're up to 18 million. That's the contingency?

16:35A lot of that is the construction cost
16:37that went up substantially.
16:39Even the vehicle for moving the sludge,
16:42the hauling the sludge, you know,
16:44from the disposal site to the storage site
16:46is went up by another $100,000.
16:49So, you know, the vehicle cost just was surprising.
16:52It went up at $120,000.

16:55But I think either way, over time,
16:56we'll make up the money and then the savings.

17:02it's still a benefit to the town
17:03from the minute the project goes online.

17:36is a public hearing regarding chapter 301,
17:39zoning and land development.
17:41And I would ask Matt Charters to come up

17:50So, we're talking about alternative parking techniques today.
17:52This is an amendment to our existing code.
17:54As the board is aware, 301.231.F.5 deals with alternative parking techniques.
17:55Mr. Thank you.
17:56technique so when the town engineer or the consulting engineer in consultation
18:02with the planning department permits on a site plan application you can use
18:05what's called pervious parking techniques so that's pervious asphalt
18:09porous concrete or other permeable sources that can be pavers it can be
18:13gravel etc so we are running into situations where applicants are going
18:19beyond the zoning requirements of a particular zone that they're in they're
18:23either going over their far or their building lot coverage but what's not
18:28happening in concert with that they're not going over their impervious surface
18:32coverage so instead of seeking a variance for all three they're only
18:35having to get variances for their building lot coverage and their their far
18:40where this is actually another thing that they would need a variance for so I
18:43will read in what the notation is going to be just to clarify that so it'll be a
18:47letter C under 231 f5 note alternative pervious paving technique shall only be
18:53permitted
18:53in place of and as an alternative to traditional drainage structures
18:57including but not limited to subsurface catch basins dry wells recharge basins
19:02retention ponds or detention ponds and shall not be utilized to exceed or
19:06circumvent maximum building lot coverage maximum floor area ratio or maximum
19:11impervious surface calculations permitted in the applicable zoning use district
19:14and shall instead be considered part of and shall contribute to the impervious
19:18surface calculation for the purposes of zoning so basically your entire parking
19:22area or your entire parking area will be permitted in the area that you are
19:23currently in the area will count toward your impervious surface calculation in a
19:26nutshell any questions

20:16with lot coverage and FAR and which driving the,
20:21and currently complies with the current
20:23impervious surface calculation.
20:25With this change, and when people use pavers,
20:28it's usually to bring down the impervious surface
20:31calculation, right, so to get that calculation number
20:34correct, or under the 25% or whatever might be
20:37in the zoning.
20:39So I have two projects in particular that currently
20:42conform, but when this gets approved,
20:46they will not comply any longer with the maximum
20:49impervious surface calculation and will have to go
20:51to the zoning board of appeals for it.
20:53And I was just wondering if there's any consideration
20:57that could be given, because right now,
20:58the way the existing code is, the town engineer
21:02and the planning department have the ability
21:05to tell an applicant whether or not they can use
21:07impervious, or impervious pavers, right?
21:10So the impervious pavers will bring down
21:12the impervious surface calculation.
21:15And I'm wondering if there's any way to get
21:16that done.
21:17And I'm wondering if there's any consideration
21:18that can be given discretion where either the building
21:21department or the planning board can say,
21:24okay, in my client's situation, we see that your
21:27project complies to lock coverage,
21:29your project complies with FAR.
21:31And if we don't let you use the impervious pavers,
21:34you're going to be way over on your impervious
21:37surface calculation.
21:38And I was talking to Mr. Charters about,
21:40he used to work in Southampton planning,
21:42and he's familiar with the building department,
21:46and he's familiar with the building inspector.
21:48And he's familiar with the building inspector's
21:50department there.
21:51And the building inspector has the discretion
21:53to determine whether or not an accessory building
21:55is in fact no longer accessory and has taken over
21:58and is now the primary use.
22:00There's no calculation number.
22:02It's up to the discretion of the building inspector
22:04if he feels that your garage,
22:06which is now twice the size or three times the size
22:08of your house, is no longer an accessory structure.
22:13He or she, the building inspector,
22:15can send it to the zoning board for an assessment.
22:16And I think that's a very important interpretation.
22:18And I was just wondering if there's any kind of discretion
22:20that could be built into this code amendment,
22:22that way you don't have zoning board of appeal applications
22:25for the situation that I'm talking about.
22:27I understand it wasn't meant to catch this code amendment,
22:31to catch the situations I'm telling you about.
22:34But I think inadvertently you are going to have applications
22:37that are going to be caught in this net.
22:39And I'm just asking the board to consider some sort
22:42of discretionary judgment
22:46on the part of planning and building that if they see
22:49that you are complying and that you did comply,
22:51and that if you do need the pervious pavers to bring
22:55down the impervious surface calculation, that you can do
22:59that without being driven into a variance situation.

23:22We don't want to, I don't think we're looking
23:23to penalize anyone.
23:25We're like looking for the situation where there's a whole,
23:28I say a wholesale of going beyond what's permitted
23:30by the code.
23:32However, I would think in this case
23:33with the impervious calculation, if they had to get a variance,
23:35the zoning board when offering relief would take those factors
23:38into account.
23:39So they would look at their FAR.
23:41They would look at their building lot coverage and say,
23:42okay, you're complying, so, you know, obviously,
23:45it's discretionary to the ZBA, but they could be more apt
23:48to grant you relief if you're already complying
23:50in those other two regards.
23:52Right, but that just makes the process longer.
23:54So my question to you is, and I like the suggestion that,
23:58you know, the planning department
24:01and or the building department can have some discretion.
24:06Understood.
24:07I mean, if there's board support,
24:08we can consider adding language to that effect
24:10or leave it to the ZBA.
24:12I mean, what's the rest of the board think?
24:15I think she made a very valid point.
24:17Yeah, like I said, we don't want to penalize.
24:19We want to make sure there's wholesale compliance
24:22to the extent that we can.
24:24Yeah, I would support adding language.
24:27I agree with Councilman Kern.
24:29I think that the planning board would even be happy with that
24:32and probably the ZBA.
24:33I think it's a good move.
24:35Yeah, we can tighten it up and make it very clear.
24:38I think that's an easy thing to do and obviously
24:40because we're making somewhat of a substantial change,
24:42we'll have to re-notice and bring it back.

25:40to kind of review the implications of it

25:51And I think, you know, who does it affect?
25:54What landowners?
25:55Are we keeping the verbiage the same?
25:58But in addition, are we in compliance?
26:01So we had reached out to Suffolk County,
26:03and they said that we could do this for six months, I believe.
26:05And so now we're extending it.
26:06So we may be in violation of that.
26:08I'd like to know.
26:09I'd like to be able to have a little time
26:11other than putting something forward at 4.30 when all this,
26:14all the town offices are closed.
26:16And I could not be here personally this morning
26:18attending a funeral service.
26:20I just think you've got to be able to give us time
26:22to properly govern.
26:24I support that as well.
26:26You know, I respect your email that you sent
26:30that something of this magnitude needs discussion.
26:33And, you know, and so I would support tabling it.

47:24and disappeared, never heard about it again because she has her property and it all goes well.

48:26And you could tell the smile on that child's face, how great it was.
48:31Now, you're thinking of taking over this property, right?

48:40And I don't know why you wouldn't want to have a children's center there.
48:43Would you ever just think of yourselves, I'd say your children, but maybe your grandchildren,
48:49taking them there and watching them work and do things in the center, having a great time,
48:54and then maybe going out and have a little ice cream cone afterwards.

I'd like to mention Friday, June 7th, CAP is holding and hosting their 37th annual Say No to Drugs March starting at Pulaski Street School. That begins at 9.30 a.m. Following the march, there will be a brief ceremony on the steps of the school. And they will address... People will address the students and the community after the ceremony. The Loyal Order of Moose Lodge number 1742 will serve a picnic lunch to all students and guests. Saturday, June 8th, the Tour de Cure American Diabetes Bike Ride at the Hallockville Museum Farm starts at 6 a.m. Check-in is at 5 a.m. Watch out for the bikers on the roads. And last but not least, Sunday, June 9th, is Duck Pond Day and Street Market in Wading River. It is an annual tradition hosted by the Duck Pond Society and Wren Design Company. The event includes food, drinks, music, arts, and crafts, vendors, and some free giveaways. So those are just a few items that are going on this weekend around here. All right, so just a quick synopsis where we're at. Since 2019, 2019, back in the feasibility stage, all the way to 2024, this town has moved forward with plans and specs for the biosolids project and diligently have gotten to the point where we're ready to embark on the construction phase of this project. It's very exciting. And I believe this resolution is looking to assure that we match the proposed bond amount that was initially established way back in 2021 to the current project costs that match the actual construction bids that we have received just recently. Throughout the project's timeline since 2019, COVID, supply chain issues have really impacted this project cost and timeline. And this proposed bond amount of $18,650,000 includes this cost and timeline impact as it stands today. And I'd like to point out that 75% of those cost impacts are due to material labor increases during that time period. But even with that, we're still in the process of getting to the point where we're ready to go. So, I would like to thank the board for their support. I'm going to turn it over to Chris Weiss. The new system will lower the average sludge handling costs from $1.2 million a year to $500,000 a year, a substantial decrease. The sludge handling costs savings, along with paying off the bond over a 20-year period, equates to approximately $96,000 a year of savings for those first 20 years paying off the bond. But then when the bond is paid off, it will ratchet up to $860,000 in savings over the course of the year for the remaining 10. The total savings to the town over this life cycle of the new sludge project is $10.5 million to bring this in. I'd like to point out that in addition to the cost savings that are demonstrated by moving forward with this project, this new biosolids system is providing a huge environmental benefit also. The new process reduces waste and waste management costs, and it's a huge investment. But there's also a huge area of waste management that's being disposed of that is currently at 3,400 tons per year down to 700 tons per year. That's an 80% reduction of waste solids that have to be disposed in landfills and other places. So it's a win-win on both sides. That's a quick synopsis of where we're at today. I know it's like a lot of people are going to say, I'm going to go to the next one. Last time you were here, we're at 16 million. We're up to 18 million. That's the contingency? There's contingency. A lot of that is the construction cost that went up substantially. Even the vehicle for moving the sludge, the hauling the sludge, you know, from the disposal site to the storage site is went up by another $100,000. So, you know, the vehicle cost just was surprising. It went up at $120,000. Thank you. But I think either way, over time, we'll make up the money and then the savings. Yes. This is an amendment to our existing code. As the board is aware, 301.231.F.5 deals with alternative parking techniques. Mr. Thank you. technique so when the town engineer or the consulting engineer in consultation with the planning department permits on a site plan application you can use what's called pervious parking techniques so that's pervious asphalt porous concrete or other permeable sources that can be pavers it can be gravel etc so we are running into situations where applicants are going beyond the zoning requirements of a particular zone that they're in they're either going over their far or their building lot coverage but what's not happening in concert with that they're not going over their impervious surface coverage so instead of seeking a variance for all three they're only having to get variances for their building lot coverage and their their far where this is actually another thing that they would need a variance for so I will read in what the notation is going to be just to clarify that so it'll be a letter C under 231 f5 note alternative pervious paving technique shall only be permitted in place of and as an alternative to traditional drainage structures including but not limited to subsurface catch basins dry wells recharge basins retention ponds or detention ponds and shall not be utilized to exceed or circumvent maximum building lot coverage maximum floor area ratio or maximum impervious surface calculations permitted in the applicable zoning use district and shall instead be considered part of and shall contribute to the impervious surface calculation for the purposes of zoning so basically your entire parking area or your entire parking area will be permitted in the area that you are currently in the area will count toward your impervious surface calculation in a nutshell any questions questions from the thank you man Kim

I can believe judge 737 Roanoke Avenue I had already spoken to mr. charters mr. Bergman and head head head head head head head head head head head head head head head head head head head head head head [transcription gap] with lot coverage and FAR and which driving the, and currently complies with the current impervious surface calculation. With this change, and when people use pavers, it's usually to bring down the impervious surface calculation, right, so to get that calculation number correct, or under the 25% or whatever might be in the zoning. So I have two projects in particular that currently conform, but when this gets approved, they will not comply any longer with the maximum impervious surface calculation and will have to go to the zoning board of appeals for it. And I was just wondering if there's any consideration that could be given, because right now, the way the existing code is, the town engineer and the planning department have the ability to tell an applicant whether or not they can use impervious, or impervious pavers, right? So the impervious pavers will bring down the impervious surface calculation. And I'm wondering if there's any way to get that done. And I'm wondering if there's any consideration that can be given discretion where either the building department or the planning board can say, okay, in my client's situation, we see that your project complies to lock coverage, your project complies with FAR. And if we don't let you use the impervious pavers, you're going to be way over on your impervious surface calculation. And I was talking to Mr. Charters about, he used to work in Southampton planning, and he's familiar with the building department, and he's familiar with the building inspector. And he's familiar with the building inspector's department there. And the building inspector has the discretion to determine whether or not an accessory building is in fact no longer accessory and has taken over and is now the primary use. There's no calculation number. It's up to the discretion of the building inspector if he feels that your garage, which is now twice the size or three times the size of your house, is no longer an accessory structure. He or she, the building inspector, can send it to the zoning board for an assessment. And I think that's a very important interpretation. And I was just wondering if there's any kind of discretion that could be built into this code amendment, that way you don't have zoning board of appeal applications for the situation that I'm talking about. I understand it wasn't meant to catch this code amendment, to catch the situations I'm telling you about. But I think inadvertently you are going to have applications that are going to be caught in this net. And I'm just asking the board to consider some sort of discretionary judgment on the part of planning and building that if they see that you are complying and that you did comply, and that if you do need the pervious pavers to bring down the impervious surface calculation, that you can do that without being driven into a variance situation. Go ahead, Bob. No, that makes a lot of sense to me, because it's pavers, the impervious, right? Correct. We don't want to, I don't think we're looking to penalize anyone. We're like looking for the situation where there's a whole, I say a wholesale of going beyond what's permitted by the code. However, I would think in this case with the impervious calculation, if they had to get a variance, the zoning board when offering relief would take those factors into account. So they would look at their FAR. They would look at their building lot coverage and say, okay, you're complying, so, you know, obviously, it's discretionary to the ZBA, but they could be more apt to grant you relief if you're already complying in those other two regards. Right, but that just makes the process longer. So my question to you is, and I like the suggestion that, you know, the planning department and or the building department can have some discretion. Understood. I mean, if there's board support, we can consider adding language to that effect or leave it to the ZBA. I mean, what's the rest of the board think? No. I think she made a very valid point. Yeah, like I said, we don't want to penalize. We want to make sure there's wholesale compliance to the extent that we can. So. Yeah, I would support adding language. I agree with Councilman Kern. I think that the planning board would even be happy with that and probably the ZBA. I think it's a good move. Yeah, we can tighten it up and make it very clear. I think that's an easy thing to do and obviously because we're making somewhat of a substantial change, we'll have to re-notice and bring it back. I'd like to talk about the eminent domain of the Long Island Children's Center that was brought up a couple of weeks back. I wish I knew about it earlier and I would've spoken before the resolution. Tim, I remember, excuse me, Supervisor, I remember that one time on the corner of Sound Avenue and Penny's Road, they wanted to do a takeover that home. And before that meeting, you came in and you tabled that meeting because you had spoken with the owner of that property and disappeared, never heard about it again because she has her property and it all goes well. I hope the same thing can be happened with my friend Larry Oxman. Just to let you know, I know Larry Oxman longer than anyone in this town, probably anyone on this board. We've been friends for many, many years, going back to the 70s. Larry's got a great family. I've been to the cardboard boat races when Larry's kids won the race, and the smile on their faces was incredible. Nothing, I mean, every parent would love to see a smile that I saw that day and the joy between them all. As far as Long Island. Sorry, I get a little nervous when I'm up here. Children's Science Center goes, Larry invited me to come over for a couple of meetings there, and they all went very well. And when I was there one time, a child came in and was doing some investigating and doing some work over there, and one of the volunteers went over and helped that child. And you could tell the smile on that child's face, how great it was. Now, you're thinking of taking over this property, right? Down there in the prime time of our little town square that's happening. And I don't know why you wouldn't want to have a children's center there. Would you ever just think of yourselves, I'd say your children, but maybe your grandchildren, taking them there and watching them work and do things in the center, having a great time, and then maybe going out and have a little ice cream cone afterwards. It would be fabulous. I think that location is fabulous. I wish the town would work. I wish the town would work better with Larry Oxman and the center. And I hope that this will also happen. I wish I had more to say, but as I get up here, I get a little nervous and I kind of forget things that I want to say, honestly. But I think it's a great thing for the town square. I don't understand why you're thinking of doing the domain there. I just hope that there's nothing in the background that brings a hotel or more housing or that. I think we have enough of it between. All the apartment buildings I've seen go up in the last five, eight years. You know, the library over here, right down Main Street. Every other building seems to be wanting to expand, going up above the the music hall across the street. Expansion, expansion, expansion, expansion. Let's do something for the children of this town.
