Okay, Councilman Rothwell, do we have somebody here for the invocation today? We do. I believe we are blessed with the presence of Reverend Lorraine DeArment. She is from the Riverhead Council, and so I thank you very much for joining us today and leading us in our invocation. Are you welcome. Happy to be here. Thank you very much. Let us pray. Oh, most holy one, as we gather here, on this first day of April, some of us are in the season of Lent. Others are getting ready for Passover, while still others have just received the blessing of observing Ramadan. We thank you for this opportunity to come together as a community. We ask for your guidance and wisdom as we discuss the matters before us, and we pray that our discussions will be marked by respect, understanding, and a genuine desire to serve the common good. May we listen to each other with open hearts and minds, and may we find common ground in our shared values and respect for our differences. Help us to make decisions that will uplift our community and strengthen the bonds that unite us. We pray for a productive and meaningful meeting, and we ask for your blessing on all things. Okay, by the sea of blue we have here today, and the EMS people that we have in here, and the fire department people we have here, we have some proclamations to give out. A very important event occurred that was handled recently by police, EMS, and fire department, and with that I will leave it at that. Thank you. We'll turn it over to Councilman Rothwell, our liaison to the EMS people, and you have a letter I think you're going to read. Thank you very much, Supervisor. So I just will kind of go through what transpired. So on Tuesday, March 11, 2025, a 911 call was received for an aided case. An individual had collapsed on the bike path in Calverton and was unconscious and not breathing. At that time, Wading River residents Thomas Downey, who was driving his vehicle, saw the patient collapse and called 911, exited his vehicle, and began CPR on the scene. Officer Brandon Williams arrived on the scene and continued to administer CPR, where he was able to briefly regain a pulse. Just prior to the arrival of the Wading River Fire Department, the patient went into cardiac arrest and CPR was continued and administered by Officer Kiernan Fitzgerald. Upon arrival of the Wading River Fire Department, Paramedic Dan Manzella set up a manual defibrillator with a cardiac monitor, while EMT Cameron Rothwell administered oxygen to the patient. Together, the team administered one shock, converting the patient back to a normal heart rhythm. The patient then regained consciousness and was moved to the ambulance, where Chief Denise Gluck established an IV, while Paramedic Dan Manzella and EMT Cameron Rothwell obtained a 12-lead follow-up EKG. The team established the patient's vitals, and medical information was sent in advance to the hospital, Peconic Bay Medical Center, where they waited for the patient's arrival. The patient was transported to Peconic Bay Medical Center in an ambulance driven by Chief Keith Ryan from the Wading River Fire Department. Today, after further medical treatment, the patient has made a full recovery. I will tell you that I have had the personal opportunity to speak to his family members, and they are incredibly, extremely grateful for everyone who participated that day in the efforts that saved their son's life. And so, I cannot speak more enough about what you do every day and how you do it. Also, an extreme proud father as well. But we are extremely grateful for how you're doing. The family is extremely grateful for everything in which you have done, and what you continue to do on day in and day out. And so, it is great to know that you are there every day protecting us and ready to respond in any day, any hour, any moment. And so, I am eternally grateful. The family has specifically asked me to express their eternal gratitude for what you have done today in saving their son's life. So today, we are here to honor seven individuals. Police Officer Brandon Williams, Police Officer Kiernan Fitzgerald, Fire Chief Denise Gluck, Fire Chief Keith Ryan, Paramedic Dan Manzeller, EMT Cameron Rothwell, and Resident Thomas Downey. So I ask you all to please come forward and join the Town Board as we give you proclamations today.

But they do have to register with the recreation department, but it is free skates from 1130 a.m. to 130 p.m. So while the kids are off with nothing to do, that's a nice place to go. So free. We have no reports for this meeting, but under correspondence, we received two letters, one from the Group for the East. That's a reference to Scott's Point. And we received a letter that was handed up at the last meeting on the Long Island Science Center in reference to a Resolution 263, and that was circulated to the Board. And that's it on the reports. But there are some concerns about the agreement that I just want to share with you. Maybe you can do an amendment or you may need to table it. I'm sure. Hopefully that wouldn't delay anything. So the town is entering into an agreement with the developer for properties for staging. It includes the Arts Council property. And part of the parking lot behind the diner. The old diner site. Owned by the town of Riverhead. No problem. I see you're charging a fee. $150,000 per lot. Awesome. Well said. Concerns though. Three. One concern is that parking is going to get pretty tight. That's a pretty choice area for parking. If you look across the street here, the third street parking lot right now has three cars in it. One truck. It's usually that way all the time. As a member of the parking committee, we would recommend that you consider letting them use this lot. As opposed to the lot right down in town that's going to be, parking is going to get much tighter down there. So you may want to make that a consideration instead of the lot directly on the waterfront. Secondly, in the agreement there, it also refers to attachments C and D. Which they have an option to move. So they can move into from the riverfront lot and those are in the first street parking lot. They're the attachments. They show the map. So there are two areas in the first street lot that they can switch to in lieu of the one by the river. Okay. The first street lot is also very busy. Obviously. And unfortunately, unlike the other properties that are part of this agreement. It refers to. The town of Riverhead being the fee owner of the parcels. And you as the town board entering into an agreement. That parcel is not owned, a fee owned by the town of Riverhead. It's owned by the Riverhead parking district. So you're also the parking board. But you would have to, I believe, do two resolutions. One for the town owned property. As the town board. And then another resolution as the parking board. For the same things to apply to the first street parking lot. Because that's not owned by the town of Riverhead. It's owned by the town of Riverhead parking district. And it's two separate boards. Same people. But you're two separate boards. It's like, you know, a board of Citibank and a board of M&T Bank. You could have the same people on both boards. But your actions have to be independent. Because it's two separate boards. The way the contract is written. It's not set up for the two boards. You may have to amend it. Or break it apart. And then lastly, if it were to be the parking district properties. That were utilized. Would that money go into the town fund? Or would it go into the parking district fund if you rent the properties? So those are just the concerns that we see here. That you should take into consideration. Okay. Thank you. Thank you, Marty. First on 303. I'd like to know on the purpose of the source of funding. Where that's coming from. It says grant or excuse me revenue transfer. And I would like to know what the purpose of that is. And I would like to know what the purpose of that is. I would like to know what's in that system. [transcription gap] did ask the community development director about that and apparently it's going to be covered under a grant for one of the budgets. What grant is that covered under? I don't remember off the top of my head. We have a lot of grants for Town Square projects in downtown so I don't recall off the top of my head which one it was. We can get that information for you. Okay if you could I really appreciate that. The second resolution I'd like to speak on is 2025-304. This is a license agreement with the IDA. It's a five-year agreement for $400 a month including electric, water, and sewer if applicable. One, there's no increase in rent over a five-year term and I'm questioning whether the displaced bid or Chamber of Commerce could be taking this space because they're a town agency versus the IDA which is a state agency. I'm going to say something you're not going to like but it needs to be said. This is like the ice skating rink. In my opinion it's another example of gross government fiscal malfeasance. Why are you constantly giving away the baby with the bathwater, with the bathtub, with the house? This is ridiculous. $400 a month? Thank you. Okay thank you. I knew you wouldn't respond. You know, I go through the north lot all the time and it's full. And I know the south lot fills up. When potentially the reuse of 127 comes along, that will create probably a great... greater need to relocate off of a downtown site. We have the Second Street property. We have the Roanoke property. We have Town Hall parking here. We have the TOD site. So it's going to be a constant and continual adjustment for the town while these development projects are going on. Thank you. I believe that the charter school entered into a lease agreement for the property on Sound Avenue, knowing, fully acknowledging what the maximum capacity was there, and I vote no. I'd just like to state that I vote yes for the following reasons. This was given to this charter school by special permit, and I'd be happy to say that I would continue to build. And I believe after the hearing that was held that there may be an issue that once given a special permit, since this was for a school, that the charter school would have the ability to continue to build. So with that in mind, I believe that in an effort to avoid any potential litigation or problem wherein we were to lose a lawsuit and they could continue to build as much as they wanted, I believe this is a good settlement. In that it's very restricted in the number of trailers that they can utilize. Two for students and one for administration. I feel that there are a number of criteria set in this, that those trailers must remain out of sight from the front of the road, that there is a removal plan with regard to this, and most significantly, that they cannot build anymore at any time in the future whatsoever. So I think with that in mind, and also recalling the number of trailers that they can use, recalling the number of students that came forward, I do believe for children that this is a very good school. And I also feel that this particular applicant, while they did the wrong thing initially and did build the trailers illegally on the site, when required to remove them by the town, they did do that. Unlike other individuals that have made applications to this town who have built things without permission and never removed them. Thank you. I think it's a good thing to allow them to continue to grow and continue to grow in terms of having options for students to go to different schools instead of just having one and I'm pretty satisfied with the with all the covenants that are in place so they have after they made the first mistake as was pointed out they did remove the trailers from the site and at the end of the day my biggest concern is not so much their trailers as it is kids being able to get the opportunity to get an education so I vote yes. Hi, good afternoon. Kathy McGraw from Northville. I'd just like to make a quick comment on the conditional negative declaration that you have approved for the amended site plan of Island Water Park. I understand that you have two letters from a couple of secret and a letter from a couple of secret letters. Experts. The group for the East End and Barbara Blass, a former board member and longtime planning board chairman. Both have pointed out that your conditional negative declaration on this amended site plan is contrary to law for a number of very solid reasons. But the one that jumps out at me is that this proposed action is a very solid action and that the amended site plan should be a type one action, not an unlisted action as you have categorized it. This town board acknowledged this when you classified a prior amended site plan for Island Water Park as a type one action. And when you did so, you stated that you were doing so because SECRA requires that any changes of use and changes to an original site plan that was classified as a type one action must also be classified as a type one action. And you know that on Water Park, the initial site plan was indeed classified as a type one action. So it appears to me that you know what SECRA requires, but for some reason you're ignoring that for the current, and I'm not even sure if you're aware of this, but for some reason you're ignoring that for the current amended site plan for Island Water Park. And so I'd just like to know, Mr. Howard, in your opinion, do you disagree that this is a violation of SECRA? Howard Howard. I disagree. Can you explain why? We have our, one of our planners coming up to discuss the determination. Great. Thank you. So the section in the Riverhead Town code that refers to the environmental quality of the land, the section in the Riverhead Town code that refers to the environmental quality of the land. The same thing in environmental quality review, where it says parking, parking facilities of 50 spaces or more. That code was never intended to classify every action. So by that logic, if there's an existing commercial shopping center on 58 and they want to do facade renovations by that logic, that site plan would be considered a type one action. This issue actually came to light for previous planning board counsel, Dick Ehlers. Karen Gleth was reviewing a site plan application at the target site, site uh the target property on 58 and that specific question was raised uh dick ellers at that point offered an opinion that the code was not drafted to sort of capture every single action on a site with more than 50 parking stalls it was relating to the creation of 50 or more parking stalls allen water park was not creating 50 new parking stalls as a result of their application it was amendment to the site it did not result in the creation of new parking to the comment that the prior staff report i will acknowledge i did write a prior staff report again that was reviewed by a prior planning director and was approved under his recommendation in terms of secret requiring every amendment to a site being classified as a type one i just i don't find that to be accurate and mr bergman the language in the resolution that indicates that ! the application should be reviewed by the dec and the suffolk county health department those agencies would review this proposed action by island water park either way correct correct and i did i did receive those comments and we will respond to them which is requirement under the conditional negative declaration under secret so we will respond to that and secret for a condition negative declaration does allow for minor amendments to a condition negative declaration uh doesn't really set a threshold for what's a minor amendment or a substantial amendment uh it speaks really if there's any significant issues that were raised in terms of mitigation of a proposed project um but again you know the the comments we received were not necessarily relating to any new factors or new mitigation that would be required under that application it was more procedural so i think we can correct that pretty pretty easily but again we will formally respond to all the comments that we receive that are submitted to the town clerk so you are correct in that regard so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so so But you're comfortable then that this doesn't need to be a type one action? And I think 150 of those comments were to keep that Long Island Children's Science Center where it should be, right there in the town square. I hope that you take a chance and read these comments. First I wanted, I don't know how many people saw 12 Angry Men at the Suffolk the last few days, but it was an extraordinary performance. And I gather the first time live theater has been at the Suffolk, which surprises me. But in any case, it was as an evening of theater of tremendous quality. But also they provided an opportunity for students from the area to come and see a show and be introduced to questions about how the legal process works and what actually happens in a jury room. And I think that's a great thing. And I think that's a great thing. But also there was a lot of talk about the role of judges of the jury room. And they ought to be commended for that educational role. Judge Hulse participated in the talk back, was also eloquent and very informative, including a number of us were struck by the fact that it was 12 Angry Men. There were no women in the jury. And she observed that at that point in the 60s, women simply weren't on juries. And so we have to. recognize how far we have come. I wanted to quickly follow up on what I said before, which was talking about the architecture of the town square and the environment of the town square. From what the person, the crafted person just said, we're talking about, if I understand the geography, we're talking about the east end of the square. The science center is the west side of the square. Both will affect the overall environment. I hope that your discussion of the movement against the science center, first of all, I hope you resolve it through your private conversations, but also I hope that if we get to that point of that hearing in May that the larger impact on both sides, the public and the private, will be considered, and also that there be the maximum amount of transparency about who in the private sector is going to gain from this use of public resources. I mean, there's lots of stuff talked about and things show up in articles, but I think as much as possible to have transparency about what the underpinnings financially are would be very helpful.
