0:30Let's take that seven mile bridge, that's gorgeous.
0:32Yeah, I went to the seven mile bridge.
0:33Good evening ladies and gentlemen, welcome to the August 13th meeting of the Zoning Board of Appeals.
0:39If you all please rise and join me in this pledge of allegiance.
0:44I pledge allegiance to the flag of the United States of America,
0:48and to the republic for which it stands,
0:51one nation, under God, indivisible, with liberty and justice for all.
0:57Be seated please.
1:00And Otto, if you watch and get better first.
1:06Happy birthday.
1:08Many happy returns.
1:11Who likes regrets?
1:13Crack it up.
1:14All right, so we do have one request for extension on.
1:17Appeal number 2025-029, Yvonne Ferrara, 25 Nautical Drive in Riverhead.
1:23This was originally granted on September 11, 2025, with an expiration date of September 11, 2026.
1:29We received correspondence from the applicant's design professional requesting the first one-year extension, so that would begin on September 11, 2026, and it would expire September 11, 2027.
1:41So moved.
1:42Second.
1:43Aye.
1:49How do you vote?
1:51Aye.
1:54And I vote aye.
1:56So adjourned.
1:57So our public hearing tonight is appeal number 2026-012, Jody Ordeone, 735 Manor Lane, Jamesport, Suffolk County, tax note number 600-22-1-1.2,
2:14agricultural protection zoning to legalize a pergola and three sheds.
2:17applicant request variances and or relief from Town Code chapter 301-37
2:23a1a where three sheds one directly on property line and pergola in front yard
2:28where accessory structures are not permitted in the front yard and chapter
2:32301-39 where impervious surface coverage is 18.5% maximum permitted is
2:3815% this was adjourned from July 9th and then previously from June 11 it was
2:46re-noticed due to additional relief for impervious surface coverage.
2:50Senator, did you testify the last time? No, sir.
2:53Brooke Everson from my office. Want to raise your right hand, please? Sure.
2:57So with all truth, thank you for your truth. Would you hand down, please, a loud, clear voice.
3:01Please state your name and your address. Anthony Portillo, architect.
3:05We are 12500 Main Road, Manitou.
3:08All right. How can we help you? We are here requesting a variance
3:12for as-built structures there are there is a pergola in the front yard I'm
3:20sorry the pergola also would need a front yard variance and then there's
3:25also three sheds where our existing were existing prior to the owner buying the
3:35uh the lot um just my thoughts on this uh the area surrounding this residence is it's kind of
3:43strange because it's like all agricultural and our neighbor business printed this out like just
3:49a bunch of greenhouses just so we understand we've all visited the location just uh so i thought i
3:57really think that based on what we're asking for it's pretty reasonable request for the area
4:05there was a pool approved by the board of pool granted for the front yard that
4:14was installed right so the pergola is next to the pool
4:18well one of the issues we have like discuss with you is by the pergola
4:23listed is a chimney is that correct it's uh yeah there's like a chimney out of
4:30pergola that's like a fireplace.
4:34One of our concerns is about
4:36if you need a
4:39if you have a fence around it, secondarily
4:43if the fire marshal
4:46would approve such a location for pergola.
4:53I mean, in my opinion, I would say that as long as the flu
4:59meets code in regards to distance from the ridge or from the well that's what we're inclined to do
5:05with it we'd make it subject to approval of the fire marshal i would agree with that and i would
5:10say building code as well make sure it's safe i will know it probably wouldn't because it's
5:15a residential property it wouldn't be reviewed by the fire marshal but the building inspector
5:19is a code official so the better wording is code official the appropriate official yeah the
5:23requirement would be like 10 feet that three feet above that 10 foot plane so if they don't meet
5:28that requirement i think they would have to extend the chimney to meet that requirement
5:35the other thing is the the one shed uh i guess it's on the north side
5:41the first one as you come in yes sir it's right on the property line can you move that
5:47not a problem five feet off the one five feet please no problem
5:53Is that A?
5:58Yes.
5:59Yep.
6:03And then there's an agricultural buffer.
6:07That's got to be the, is that the west side?
6:10I think it's the back of the house.
6:12Yes.
6:12I think it's the west side of the house.
6:14Yes, the 25-foot agricultural buffer.
6:18So it seems like from some of the satellite images that we reviewed in the pre-meeting,
6:24that there's some...
6:26I don't know exactly what's on it.
6:28I know what you're referring to.
6:30It's a fence and kind of a home for goats.
6:35Okay.
6:37So she has her goats living in this fence.
6:40She has like a doghouse.
6:42It's kind of like a doghouse, but the goats live in it.
6:44Move it if they have to is the note I have here.
6:50If that's what the board is requesting, they'll move it.
6:52But that's what it is.
6:53Yeah, we're requesting that they move whatever's in the agricultural buffer.
6:56Just scoot it out so it's outside that buffer.
6:58Right.
6:59Outside.
7:00Okay.
7:01So in there, property outside the buffer.
7:03We're talking things that are structures like...
7:06There is like a...
7:07A goat house in there.
7:09Yeah, it's like a dog house that the goats live in.
7:11But sure.
7:12This is a Tom Brady.
7:14I wish it was.
7:18It's very boring.
7:19Anything else?
7:22So move into their yard.
7:24Outside.
7:25Outside of the 25-foot buffer.
7:27Outside buffer.
7:27Got it.
7:28We need to get.
7:30Okay.
7:31Any other questions?
7:32We're good?
7:33One question.
7:33So I would just resubmit this back with those changes?
7:38The site plan?
7:40Oh, after the fact.
7:42Not propose it.
7:42move then you give us a final survey okay give it to the building department
7:46so if the board is inclined to grant with those conditions the written
7:52determination will have them in there the building department will get a copy
7:55of that and then you'll have to update the site planner survey with them and
8:00then submit the final when everything's done God thank you with respect to
8:08appeal number 2026-012. I move that the appeal of Jody Ordeone, 735 Manor Lane, Jamesport, STM number 600-22-1-1.2, Agricultural Protection, APZ Zoning, for variances and or relief from Town Code, Chapter 301-37A1A, where three sheds, one direct,

8:48coverage is eighteen point five percent maximum permitted is fifteen percent be
8:53granted as long as the applicants relocate the shed located on the
9:02property to comply with the shed setbacks which would be five feet from
9:08the property line and this would be also subject to the inspection and approval
9:13of any pool fence that's there and required as well as the chimney in the
9:19perogola by the appropriate official from the building department and the
9:23removal of any equipment any playground equipment and equipment
9:32any structures and as noted any goat houses or goat structures that are located in the
